All visitors to this website (theworkerswardrobe.com.au) are entering a binding legal agreement on the terms and conditions contained herewith when using the website. This contract is between the visitor and The Workers Wardrobe and by using this website means acceptance of these terms and conditions.
Our services are available only to, and may only be used by, individuals who can form legally binding contracts under applicable law.
We reserve the right to amend the terms and conditions from time to time. It is your responsibility to check the terms and conditions before placing your order and/or using our website. Your continued use of The Workers Wardrobe website will be taken to be acceptance of the new terms.
Orders
The Workers Wardrobe only processes orders with immediate payment. Therefore, payment of the order needs to be made at the time the order is processed. No orders will be processed without payment.
Prior to shipment, The Workers Wardrobe will advise if there is any item/s unavailable and will provide an estimated delivery date and/or offer an alternative product to you. Any item/s that are mutually agreed to be placed on backorder will be shipped as soon as the item is available. If the item/s is no longer available, The Workers Wardrobe will refund the unit price for the missing item/s only. The Workers Wardrobe has the sole legal right to determine to refund, or supply new or replacement items on any order that is delivered with missing or incorrect items.
Although every effort is made to ensure consistency of Fabric Colours, Dye lots can vary slightly from batch to batch.
The Workers Wardrobe will try to deliver all products on time but are not responsible or legally liable for any delays in delivery to the purchaser including if products are not delivered by a specified due date.
You acknowledge that despite our reasonable precautions, products may be listed at an incorrect price or with incorrect information or may be unavailable. This may be due to an error or similar oversight. We reserve the right to cancel an order in that event.
We may also cancel an order if we believe that it is being made in contravention of this agreement, or in contravention of the rights of any person or any law. We may cancel an order even if it has been confirmed and the customer’s credit card has been charged. We reserve this right up until the time of delivery of the product to that customer. If a cancellation of this nature occurs after the customer has been charged for the product, we will immediately credit the customer’s credit card for the amount in question.
Delivery
Delivery will be made by postal or courier service at The Workers Wardrobe discretion and will be paid for by the customer. The price indicated at time of purchase is an estimate only, and should the freight cost vary once the order is processed, we will contact the customer to confirm the new cost before the order is dispatched.
The Workers Wardrobe will not be liable for any loss suffered by you if you provide us with incorrect delivery details. It is your responsibility to ensure The Workers Wardrobe has current details of your postal/delivery address and all other details.
Embroidery
By deciding to use our embroidery service, the customer has indicated that they accept these terms & conditions.
The customer will provide us with a high quality image of their logo or their design file in the correct format.
The customer must complete The Workers Wardrobe embroidery order form which will be supplied on order placement. This will include the embroidery dimensions, position on the garments, specific PMS colours, and more.
The Workers Wardrobe will then email a quote/invoice for the embroidery work which the customer will need to accept prior to proceeding. If orders are emailed to us, an updated invoice for the order will be sent, so please check it carefully, as this is what The Workers Wardrobe will use for order processing. The Workers Wardrobe does not take any responsibility for incorrect stock of any description ordered once the customer has approved the invoice.
Once approved, The Workers Wardrobe will commence on digitising the logo, if required. Once digitised, a visual of the logo will be emailed for approval. Included in the set-up cost is a physical sample stitch out (up to 12000 stitches) which, if required, can be posted for your approval. Further changes to the design may incur additional set-up charges. The Workers Wardrobe requires the customer’s approval in writing (email confirmation accepted) to proceed with the embroidery.
All embroidery prices are charged as per each individual quote.
The Workers Wardrobe standard turnaround time for despatching orders with embroidery is 10 working days from artwork approval or 10 working days from receipt of the clients order for repeat customers. The Workers Wardrobe strives to get each order out in the quickest possible timeframe assuring the highest quality.
Embroidered items return policy - We cannot refund or exchange garments once garments have been embroidered unless the garment has been supplied incorrectly in regard to style, size, or colour as has been ordered by you. If there has been an error in supply we will arrange pick-up of the incorrect items. Garments damaged by embroideries on thin materials in which the client has instructed that these items to be embroidered (as some needle damage can occur on rare occasions - especially large or heavily stitched embroideries, or unsuitable materials), will not be refunded or replaced.
Returns
The Workers Wardrobe will only accept returns subject to the following conditions;
The customer must notify The Workers Wardrobe in writing of their intention to return goods and the return MUST be accompanied by a return authorization number (RA) issued by The Workers Wardrobe in writing before such return will be accepted.
All goods must be returned to The Workers Wardrobe within seven days of receipt by the customer.
Goods returned must be accompanied with a copy of the relevant invoice, as well as The Workers Wardrobe return authorisation number (RA).
If there is any missing item/s in the order, the customer must notify The Workers Wardrobe in writing within 48 hours of receipt of the goods.
The Workers Wardrobe shall not accept or agree to a credit claim once the item has been decorated with the approved artwork.
For undecorated garments where the client has ordered the incorrect style, size or colour, a 15% or a minimum of $25.00 handling fee will be charged on any credit for the return of all goods. We will happily offer an exchange but we will not refund your purchase unless the garments are faulty or incorrectly labelled. Freight costs will be at the expense of the customer.
Discontinued stock items are not eligible for return under any circumstances.
Goods returned must be in the original condition as sent, this includes the garment bag being unmarked and all tags intact or they will not be accepted for credit.
When you place an online or off line order with The Workers Wardrobe you are entering into a contract between you as a single entity, the company or organisation you represent and The Workers Wardrobe. By placing your order you agree to be bound by our Terms and Conditions.
Pricing
All prices are subject to change periodically. If goods are out of stock, we will quote the price accordingly.
General
The customer assumes all risk in the goods at the time of dispatch and it is the customer’s discretion to insure all goods that are at risk.
If the customer requests an order to be sent to a third party, the risk rests with the customer only. The Workers Wardrobe accepts no liability on any order sent to a third party.
The parties hereby agree that the proper law of all contracts arising between the customer and The Workers Wardrobe is the law of the State of Queensland and the parties hereto agree to submit to the jurisdiction of the Courts of that State.
These terms and conditions are the only contractual terms which are binding upon The Workers Wardrobe as well as any conditions which are imposed and cannot be excluded by law. All other conditions, warranties, representations, statements and obligations, whether expressed or implied are to the extent permitted by law hereby expressly excluded.
